As the parent company, the Joint Data Processor is I.L.M.E. S.p.A with registered office at Via Marco Antonio Colonna, 9, 20149 Milan, Italy.
Type of data processed
I.L.M.E. S.p.A. handles different types of personal data in the context of relationships with its customers, potential customers, suppliers, employees, collaborators, partners, and similar.
- Browsing data and cookies
In principle, it is possible to browse the site without having to provide any personal data. The site is divided into separate sections, some of which may require the entry of data, while for others it is never necessary.
In their normal operation, IT systems used to operate the site acquire certain data that are then implicitly transmitted in the use of Internet communication protocols. They can include information on the geographic area from which you are browsing, the device used, type of browser, and pages visited by the user during the session. It was decided not to store the user’s IP address, imposing its subsequent identification.
Browsing data are then stored anonymously and are mainly used for statistical information, in order to verify the proper operation of the site and to improve its usability.
For more information about cookies, please refer to the appropriate section.
- Data provided voluntarily by users/visitors
When users/visitors communicate personal data to access certain services or make requests via email, I.L.M.E. S.p.A. acquires such data and processes them exclusively to respond to the request, to identify the user and provide the service.
Registration on the website of I.L.M.E. S.p.A. or the request for information and services from users may involve the collection and consequent processing of personal data such as name, surname, email address, telephone number, address, profession, etc.
This type of data could be collected during:
- Compilation of a request form and/or site registration
- Participation in corporate events
- Participation in trade fairs and industry events
- Sending requests via email
The processing activity will not concern data of a sensitive nature, pursuant to Art. 9, Heading I (“Special categories of personal data”) of the Regulation (data “…suitable to reveal racial and ethnic origin, religious, philosophical or other beliefs, political opinions, membership in parties, unions, associations or organisations of a religious, philosophical, political or trade union nature, as well as personal data suitable for revealing the status of one’s health and sexual life”).
Processing purposes and legal basis
I.L.M.E. S.p.A. may process personal data for the following purposes:
1. Manage site registration and/or any connected APPs, in addition to activities related to the use of the services offered therein, as well as access to particular sections of the site (e.g. reserved areas). Send “transactional” emails related to the site registration procedure, APPs and the maintenance of active accounts (legal basis: execution of contractual or pre-contractual measures).
2. Improve and customise the user experience on the website.
3. Respond to user requests, comments or complaints, as well as to investigate such complaints (legal basis: legitimate interest).
4. Send appropriate communications on company products, services and initiatives, send periodic newsletters or customer satisfaction surveys, including via email, text message, and mms (legal basis: legitimate interest or consent when required).
5. Improve and optimise the characteristics of products and services (legal basis: legitimate interest).
6. Manage accounting, administrative, tax obligations and similar, as provided for by Italian, European or international law (legal basis: legal obligation).
7. Respect contractual obligations and conditions (legal basis: execution of a contract).
8. Manage credit protection, manage any disputes and assert the rights of the owner (legal basis: legal obligations, contract execution, legitimate interest).
I.L.M.E. S.p.A. does not currently carry out processing activities for profiling purposes, nor does it use automated decision-making processes.
Consent is necessary for processing certain types of data and for some purposes (e.g. automated communications, profiling, large-scale processing, etc.). If I.L.M.E. S.p.A. should find itself in one of these conditions, it will adequately inform users and request consent for such processing in the manner deemed most appropriate.
The user will always be able to revoke his or her consent and oppose any direct marketing activity.
Processing method and duration
The processing of personal data is carried out through electronic procedures and media and/or manually (e.g. on paper) for the time necessary to achieve the purposes for which the data were collected, and in compliance with current regulations in the field.
The company is also required to retain certain information on the basis of legal requirements, for a reasonable time as necessary to meet legal requirements, resolve disputes, avoid fraud and abuse and apply its own terms and conditions.
Optional nature of the provision of data
The provision of data processed for legal obligations and contractual performance is necessary; any opposition to such processing activity in whole or in part will imply the impossibility for I.L.M.E. S.p.A. to initiate contractual relationships.
For all other purposes, apart from that already specified for browsing data, users/visitors are free to provide their personal data. Failure to provide such data may entail the impossibility of obtaining that requested or staying informed in the best way possible.
Communication and Transfer of Personal Data
Personal data may be accessed by employees or collaborators of I.L.M.E. S.p.A., who are formally appointed and authorised for processing activities and receive appropriate operational instructions in this regard.
I.L.M.E. S.p.A. may communicate the data to:
- third parties in charge of the execution of activities connected and instrumental to the supply of products and/or the provision of services with which the Data Processor has entered into specific agreements.
- third parties for the fulfilment of obligations established by law or by the contract (such as public bodies, supervisory authorities, police forces, banking institutions, etc.).
- subsidiaries, investee companies, associates, as well as partners and/or affiliated companies.
For technical-practical needs related to processing activities themselves, some personal data may be located on the servers of suppliers and subcontractors servers or only processed by third parties, who have fully complied with the standards of I.L.M.E. S.p.A. for the protection of the processing of personal data.
Personal data will not be disclosed in any way.
As regards the transfer of data to third countries as provided for in Heading V of the Regulation, we inform you that data could be transferred to other companies of the business group, even those outside of the EU, in compliance with Articles 44-47 of the European Regulation.
Rights of data subjects
The European Regulations grant numerous rights to data subjects, which we ask you to consider carefully. The following rights are of particular significance:
- access of the data subject:
- confirmation that a processing activity of data concerning him/her is currently in progress;
- communication of the transfer of data to a third country or international organisation;
- to obtain a copy of personal data processed (if and only if the rights and freedom of others are not infringed);
- rectification of data;
- full erasure (right to be forgotten);
- limitation of processing activities;
- obligation of notification in the event of rectification or erasure of personal data or the limitation of processing;
- data portability;
The data subject also has the right to receive prompt communication in the event of a personal data breach that could damage his or her dignity and freedom.
